    • Fairness
    • Dignity

    What can the congressman do to help?
    Congressman can pass laws requiring teachers and heal h care professionals to take class or receive special traing to help them recognise the signs of physical and sexual abuse.
    What can I do?
    I can take an active role in setting up support groups and particapate in local charity events.

    Dear Congressman Mollohan,
    I am writing because I have had a family member, my aunt, who was sexuall assulted. Following the trial she was unwilling to show her face in public do the the attention that had been brought on her from the media coverage. This is a problem that many other crime victoms face. I think you should implement a law that prevents the media from giving out information without concent of the victom. This would ease the burdon that many sexually asuly victoms face. Thank you for listening. I hope you take action to help resolve this problem.

  4. You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to an attorney. If you cannot afford an attorney, one will be appointed to you. Do you understand these rights as they have been read to you? Thoughs aare your right when you are arrested. Is you are every arrested you should know but if not you don’t Offenders may now have several well-entrenched rights, but a growing number of surveys have revealed widespread dissatisfaction among their victims.     Dear Ms. Capito,
    I have currently been aware that one of my family members has been beaten and raped. Some say that the victum does not have rights but I think that the victum does have rights. Some of these rights are respect, freedom of speech, and fairness. Also, you could help her and try to catch the person who has done this to her. Finally, I can help her though this and support her but that is all I can do. The rest is up to her.

  8. The "victims' rights" movement began in a response to the spread of two beliefs. The first was the perception that the legal system was more concerned with the protection of the constitutional rights of criminal offenders and alleged offenders than they were the victims of their offenses. This was especially inflamed by numerous lawsuits alleging unconstitutional conditions in many U.S. jails and prisons, and a strong emphasis on the education and rehabilitation of those who were incarcerated, especially beginning in the late 1960s and 1970s. Advocates wanted to see affirmative help for crime victims to be at least as extensive as that provided to the offenders, and for victims to receive compensation from offenders whenever this was practicable. The second stimulus was the spread of the belief, bolstered by prominent stories in the media, that the number of released or paroled offenders returning to attack their original victims or victims' families was increasing, in some cases in retaliation for having reported the original offense.
    Most state victims' rights amendments provide for the prosecutors to stay in touch with the victims and their families during all stages of prosecution, and to stay in touch with them post-conviction to advise them of events such as parole hearings, applications for pardons or other forms of executive clemency or relief, and similar news. They may require that any pay received by an offender while incarcerated go at least in part to compensate the victims, and that royalties to any creative works such as books, screenplays or similar works created by the offender judged to be derived from the events of the offense be assigned to the victims.

Instead of picking someone to remain sober and be the designated driver, a new study has found that many young people are choosing the "least drunk" of their group to get behind the wheel after a night of drinking.
    Laws regarding drunk driving vary from state to state. These pages explain the highlights of the laws of each state in the U.S. for driving under the influence, driving while intoxicated or operating a vehicle while intoxicated. More and more law enforcements agencies are beginning to use a new high-tech tool that helps them track the alcohol consumption of previous offenders, 24 hours a day, seven days a week.
    It's not a question of whether you are legally intoxicated, it's a question of whether or not it is safe to drive when you have consumed any amount of alcohol. Research shows that impairment begins long before a person reaches the blood alcohol concentration level of .08. If you have been arrested for drunk driving for the first time, you are probably wondering what is going to happen next and what you will have to do to get your driving privileges returned.
    Drunk driving kills more than 13,000 Americans a year - that's one every 39 minutes. Authorities call it an epidemic. They say that despite all the publicity, all the education campaigns, and all the advertising over the past decade, the number of drunk-driving fatalities has not gone down.Some prosecutors have started taking a different approach to the problem, getting so tough on drunk drivers who kill people that the penalties they exact were unheard of in the past.
    “Shortly before midnight Saturday an SUV with five teens inside veered out of control on a narrow country road near Kerman, killing Melina Sandoval,19, of Madera and Thomas Nazaroff,14, of Kerman.The CHP said the car was speeding down Mckinley Avenue near Sycamore when the front passenger grabbed the steering wheel and jerked it to the right, causing the driver to lose control.The SUV flipped several times, ejecting both Sandoval and Nazaroff, who were riding in the backseat, from the car. The driver and another passenger suffered minor and moderate injuries and were taken to community Regional Medical Center.
    Investigators said none of the three teens in the backseat were wearing their seat belts at the time of the accident.
    It was also determined that all five, including the driver, had been drinking.
    Because of the circumstances surrounding the accident, the driver could be facing felony DUI and vehicular manslaughter charges”

    I hope that this opens your eyes, and that more laws can be passed and we can stop the madness of having drunk drivers.

  10. Dear Mr. Rahall,
    I just had a friend pass away, her name was Belinda McClung. She got hit head on by a drunk driver. A friend of her was in the car and he got minor injuries. The passenger went to sure and the guy who killed my best friend got away with 6 months probation and I don’t understand how that could happen. She was a great driver and I know that! She taught me how to drive! Her family got no compensation for their daughter’s death. How can that family live knowing that every single day there is killer out there who could hurt someone majorly. Maybe even kill someone else. They didn’t hear from the killer ever again after court. How do you explain that?

    I think that woman have the right to barearms.I think congressmen can do more to tell people how much violence hurts people.What I can do is let people know how much sexual assualt hurts so that we can be safe when alone at home.

    I think that there should alot more alternitaves for women who experience demestic voilence. alot of the times women dont have any rights in these kinds of cases. I strongly belive that demestic voilence is a very very serious matter to deal with. I was raised up in a home full of it. My crimanal stepfather beat my mother often and she wasnt left with alot of choice on the laws end of the sitition. I think there should be some sort of definate consiquence for men who like to beat women.

  13. In logan county ,W.V, 3 men kiddnaped a black woman, raped, beat, and made her eat dog and rat poop and stabed her 4 thmes in the same leg. The hole time they were doing thes they were calling her a nigger. All 3 of the men were white ond from a hick town and were not charged with a hate crime.
    Persoaly I think she should have more justis than she got! I think they should have got death by torcher.

    What rights do victims have?I think the victum has the right to go to court and press on it to get justice. Also I think they have the right to to take care of it theirself if they think they need to , and feel that they are in danger of losing their life.Another right they have is to decided to just walk away.
    What can the congressman do to help? I think they can help by support them and giving to victum the help and justice they should get. Also I think they should help them out just to do the right thing and get justice when justice should be served.
    What can I do? I think I can help by getting justice for the victum who should get. Also I could become a lawyer and help them out that way.

  15. Victims have the right to truth, justice and reparation. They have the right to be treated with respect just like anybody else would.

    Congress can help by supporting them and help them out just so they know they are doing the right thing unlike the victims did.

    I could help by seeing what they victim did and relate it to a problem that I might of had or somebody I know had.

    What rights do victims have? Some of the rights that criminals have are the right to be treated with fairness and with respect for the victim’s dignity and privacy, the right to be reasonably protected from the accussed offender, the right to be notified of court proceedings, the right to restitution, the right to information about the conviction, sentencing, imprisonment, and release of the offender. Are all the rights that criminals have in the state of west virginia.

    What can the congressman do to help? One thing the congressman can help is they can appoint a government representitive in the court and can also help them get a shorter or minimum sentence to their conviction.

    What can I do? One thing I can do is to write letters or post some stuff on the govs. Blog or whatever they have and to write to my senator or to my president of the united states.

  19. What I liked about ivalee's was she said that she had a friend pass away and that he only got 6 months probation and I think that is injustice and that he should have at least served 5 to ten years in prison for DUI, Hit and run, and First degree murder.

  20. i agree about pretty much everyone's things the DUI,Rapes,kidnapps,everything. I have a dui on my plate but never killed or hurt anyone with it thank got but my best friends brother killed our friend nate he will be missed so think about what youre doing when youre doing it.

    I would think that you would help the victims of the horrible crimes in the fasinity. What are the victims rights? I think that you should know the victims rights and they are the right to justice and things in that sort. What can the congressman do to help? I think that the congressman can help by making the punishment more harder than normal. What can I do? I can be more supportive to the victims than to the criminal release date from the local jail or the prison system. I would really appreciate it if you can take this letter into consideration and really think that it’s not only the victims fought all the time though. So be considerate please.

    I just wanted to write you a letter and let you know what I think of crime victims week. Say I have a sister and she goes down the street and all she says to this guy is “hey” and begins to think that she likes him and starts to follow her everywhere she goes then I feel like I should be able to protect her by any means nessisary. Don’t you feel like you would do the same if you saw someone following your familly members around.


    What the congress can do to help the victims is pass a law to be able to protect themselves even if it means killing the person trying to do something to them. Either that or at least let them protect themselfes by any means nessisary at least until they get help. I feel that justice is not doing the right thing for people that make civilians victims.


    What I can do to help if I see someone trying to mess with someone else is go and protect the person that’s being messed with at least until I get help!!!

    In response to your comment i feel that the guy that killed her should have had soem more concsequences. First Degree Murder defines Reckless indifference to an unjustifiably high risk to human life. She was my best friend and the " unjustifiably high risk " was her life. Not only did the guy only get 6 months probation he went to the hospital after the wreck and left 10 min. later because he had minor cuts. I got a phone call on my Birthday from a close frined telling me that she had passed away instantly. Crazy world this is when a 21 year old girl can die, cause of a reckless drunk driver and get away with all of it.

    I think that you have a good point, because the police actually treats the vicitim worse then they do the suspect. example: If you get hit by a drunk driver and both of you all have to go to the hospital they will pay the suspects bill cause he belongs to the state now and you will have to pay your own bill with your money.
